John H. Jackson Moot Court Competition 2020/21

The Moot Problem of the 19th edition of the John H. Jackson Moot Court concerns a dispute between the two countries of Budica (complaining party) and Dale (responding party). The measure at issue is the Presidential Decree No. 457 of 2019 (“Food Information Package” or “FIP”) that lays down various labelling schemes for proceed food products and establishes rules regarding the use of trademarks.

Thereby, the FIP raises questions regarding its compatibility with the Agreement on Technical Barriers to Trade (TBT Agreement) as well as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement). In addition, the complaining party also challenges the FIPs compatibility with the newest WTO law agreement, the Trade Facilitation Agreement (TFA). Moreover, the case poses procedural questions regarding a WTO Member state’s right to bring forward a claim before the WTO Dispute Settlement Body (DSB).
